CONSTITUIÇÃO E REFORMAS DE BASE

ERA 1987.

Estava ocorrendo em Brasília a elaboração pelo CONGRESSO de uma nova Constituição. Já era visível que sairia uma Lei Ordinária Qualquer, sem sabor de CONSTITUIÇÃO, tal era a quantidade de assuntos que os Congressistas queriam que fosse assunto constitucional. O Grupo de Estudos Avançados, sob coordenação do autor deste livro, tinha uma boa quantidade de membros em Brasília e já havia firmado os termos de um IMPOSTO como Despesas de Condomínio, além de haver este estudo para sugerir um ESTATUTO DA NAÇÃO em poucos PRINCÍPIOS para reger as diretrizes das Leis, deixando para Códigos e Regulamentos a parte transitória dessas Leis. Assim, elas seriam mais fáceis de revisar e atualizar no futuro.

Logo ao início deste livro propondo uma Constituição federal em três artigos, se apresentam Quatro Reformas necessárias e que poderiam ser delineadas na Constituição. São a Reforma Econômica, a Educacional, a Agrária e a Tributária. Na primeira parte do livro já vemos a Reforma Econômica sugerindo a forma cooperativa com propriedade privada respeitada e com a mínima intervenção estatal.

Na segunda parte está proposto o Condomínio como Reforma Tributária, oferecendo o Projeto de longa data elaborado nos debates e pesquisas do Grupo. Por muito custo e efeito de distribuição deste livro aos Congressistas com conversas finais com o próprio deputado Ulisses Guimarães, conseguiu-se incluir o parágrafo primeiro do Artigo 145 da Constituição aprovada em 1988.

Na terceira parte é abordada a Reforma do Ensino, para liberar a cultura humanista para todos, sem insistir na profissionalização escravizante, e sem burocracias, porém, perdeu o país 20 anos daí à frente prosseguindo com a mesma forma estatizada da Lei de Diretrizes e Bases anterior, depois arrochada para pior ainda. Na quarta parte, Reforma Agrária, apresenta-se a possibilidade de formar uma ampla rede de Cooperativas que, fornecendo produtos para as cidades e para exportar, também seriam Mercado Interno crescente para produtos industrializados, além de fator de estabilidade social e econômica dando ao Continente Brasil uma economia rural de preservação ambiental e familiar.

CONCLUSÃO? Embora haja uma “conclusão” na estrutura do livro que estamos resumindo, não há mesmo a intenção de concluir uma tese sobre as sugestões apresentadas, pois era, e é, uma análise AINDA HOJE ATUAL dos problemas da Nação. Quem observe o que aconteceu depois dessa Constituição, percebe muito bem que nada foi feito e seria muito melhor nosso país se estas teses tivessem sido adotadas. Lamentaremos não ter sido feito? Ou aproveitaremos esta publicação para rever as posições e saber que o País Tem Solução? Vamos dar razão aos que colaboraram para o debate deste livro que relatou e tentou evitar os problemas hoje agudos de nossa Sociedade Brasileira. Era e continua sendo urgente Revisar, pelo menos o Confisco Tributário que a Constituição deixou solto. Junto com o livro SOLUÇÃO? IMPOSTO UNIFICADO, temos aqui as bases para nova Constituição que traga Verdade e Paz. Ao que parece, esse era o objetivo deste livro e é esse o conteúdo do resumo que o autor apresentou como Conclusão.

It was 1987. 

It was happening in Brasília the elaboration for the CONGRESS of a new Constitution. It was already visible that he/she would leave Any Ordinary Law, without flavor of CONSTITUTION, such era the amount of subjects that the Members of Congress wanted that it went constitutional subject. The Group of Advanced Studies, under the author's of this book coordination, had a good amount of members in Brasília and it had already firm the terms of a TAX as Expenses of Condominium, besides there being this study to suggest a STATUTE OF the NATION in few BEGINNINGS to govern the guidelines of the Laws, leaving for Codes and Regulations the transitory part of those Laws. Like this, they would be easier to revise and to update in the future.  

Therefore to the beginning of this book proposing a federal Constitution in three goods, they come Four necessary Reforms and that you/they could be delineated in the Constitution. They are the Economical Reform, the Education, the Agrarian and the Tax. In the first part of the book we already see the Economical Reform suggesting the cooperative form with property deprived respected and with the low state intervention.  

In the second part the Condominium is proposed as Tax Reform, offering the Project of long date elaborated in the debates and researches of the Group. For a lot of cost and distribution effect of this book to the Members of Congress with final conversations with the own deputy Ulisses Guimarães, it was gotten to include the first paragraph of the Article 145 of the approved Constitution in 1988.  

In the third part the Reform of the Teaching is approached, to liberate the culture humanist for all, without insisting on the professionalization escravizante, and without bureaucracies, however, it lost the country then ahead 20 years continuing with the same nationalized form of the Law of Guidelines and previous Bases, later compressed for worst still. In the fourth it leaves, Land reform, comes the possibility to form a wide net of Cooperatives that, supplying products for the cities and to export, they would also be growing Internal Market for industrialized products, besides factor of social and economical stability giving to the Continente Brasil a rural economy of environmental and family preservation.  

CONCLUSION? Although there is a "conclusion" in the structure of the book that we are summarizing, no there does be the intention of concluding a theory on the presented suggestions, therefore it was, and it is, an analysis STILL TODAY CURRENT of the problems of the Nation. Who observes what happened after that Constitution, he/she notices a lot albeit nothing was made and it would be our country much better if these theories had been adopted. Will we lament it was not done? Or will we take advantage of this publication to review the positions and knowledge that the Country Has Solution? We will agree with the that collaborated for the debate of this book that told and it tried to avoid the problems today sharp of our Brazilian Society. It was and it continues being urgent to Revise, at least the Tax Confiscation that the Constitution left free. With the book SOLUTION? UNIFIED TAX, we have the bases here for new Constitution that swallows True and Paz. To the that seems, that era the objective of this book and it is that the content of the summary that the author presented as Conclusion.
